Terms and Conditions with Customer Information
Note: These Terms and Conditions are provided in English for convenience. In the event of any discrepancies, inconsistencies, or interpretation differences between the English and German versions, the German version shall prevail.

1) Scope
1.1 These General Terms and Conditions (hereinafter "GTC") of Yuliia Fukszon, trading under "YuliSkin Kosmetik Studio" (hereinafter "Seller"), apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller with regard to the goods presented by the Seller in its online shop. The inclusion of the Customer’s own terms and conditions is hereby rejected unless otherwise agreed.
1.2 These GTC apply accordingly to contracts for the delivery of vouchers unless otherwise expressly regulated.
1.3 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that predominantly cannot be attributed to their commercial or independent professional activity.
1.4 An entrepreneur within the meaning of these GTC is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
2) Conclusion of Contract
2.1 The product descriptions contained in the Seller's online shop do not constitute binding offers on the part of the Seller but serve for the submission of a binding offer by the Customer.
2.2 The Customer may submit the offer via the online order form integrated into the Seller's online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the Customer submits a legally binding contractual offer regarding the goods contained in the shopping cart by clicking the button that completes the order process. The Customer may also submit the offer to the Seller by e-mail, via the online contact form, by post, or by telephone.
2.3 The Seller may accept the Customer’s offer within five days:
- by sending the Customer a written order confirmation or an order confirmation in text form (e-mail), whereby the receipt of the order confirmation by the Customer is decisive, or
- by delivering the ordered goods to the Customer, whereby the receipt of the goods by the Customer is decisive, or
- by requesting payment from the Customer after the order has been placed.
If several of the aforementioned alternatives occur, the contract shall be concluded at the time when one of the aforementioned alternatives occurs first. The period for accepting the offer begins on the day after the Customer sends the offer and ends at the end of the fifth day following the sending of the offer. If the Seller does not accept the Customer’s offer within this period, this shall be deemed a rejection of the offer with the consequence that the Customer is no longer bound by their declaration of intent.
2.4 If a payment method offered via PayPal is selected, payment processing is carried out via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter “PayPal”) under the PayPal terms of use available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full. If the Customer does not have a PayPal account, the conditions for payments without a PayPal account apply, available at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full.
If the Customer selects a PayPal payment method available during the online ordering process, the Seller hereby declares acceptance of the Customer's offer at the moment the Customer clicks the button that completes the order process.
2.5 When submitting an offer via the Seller's online order form, the contract text is stored by the Seller after the conclusion of the contract and sent to the Customer in text form (e.g. e-mail, fax or letter). No further access to the contract text is provided by the Seller. If the Customer has set up a user account in the Seller's online shop before submitting their order, the order data will be archived on the Seller’s website and can be accessed free of charge by the Customer via their password-protected user account.
2.7 Before submitting a binding order via the Seller’s online order form, the Customer can identify possible input errors by carefully reading the information displayed on the screen. A useful technical means of better detecting input errors may be the browser’s zoom function, which enlarges the display on the screen. During the electronic ordering process, the Customer can correct their entries using the usual keyboard and mouse functions until clicking the button that completes the order process.
2.8 The German language is available for the conclusion of the contract.
2.9 Order processing and contact usually take place via e-mail and automated order processing. The Customer must ensure that the e-mail address provided for order processing is correct so that e-mails sent by the Seller can be received. In particular, when using SPAM filters, the Customer must ensure that all e-mails sent by the Seller or by third parties commissioned by the Seller for order processing can be delivered.
3) Right of Withdrawal
3.1 Consumers are generally entitled to a right of withdrawal.
3.2 Further information on the right of withdrawal can be found in the Seller’s cancellation policy.
4) Prices and Payment Terms
4.1 Unless otherwise stated in the Seller’s product description, the prices quoted are total prices that include statutory value-added tax. Any additional delivery and shipping costs are specified separately in the respective product description.
4.2 In the case of deliveries to countries outside the European Union, additional costs may arise in individual cases which the Seller is not responsible for and which must be borne by the Customer. These include, for example, costs for money transfers by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties).
4.3 The payment method(s) will be communicated to the Customer in the Seller’s online shop.
4.4 If advance payment by bank transfer has been agreed, payment is due immediately after the conclusion of the contract unless the parties have agreed on a later due date.
4.5 If a payment method offered via PayPal is selected, payment processing takes place via PayPal. PayPal may also use the services of third-party payment service providers for this purpose.
4.6 If the payment method “SOFORT” is selected, payment processing is carried out via the payment service provider SOFORT GmbH, Theresienhöhe 12, 80339 Munich.
5) Delivery and Shipping Conditions
5.1 If the Seller offers shipment of the goods, delivery shall be made within the delivery area specified by the Seller to the delivery address provided by the Customer unless otherwise agreed.
The Customer is obliged to provide a complete and deliverable delivery address. The name of the recipient must match the name on the mailbox or doorbell to ensure proper delivery.
5.2 If delivery fails for reasons attributable to the Customer (e.g. incomplete or incorrect delivery address, different name on the mailbox or doorbell, refusal to accept the shipment), the Customer shall bear the reasonable costs incurred by the Seller.
If the shipment is returned to the Seller for such reasons, the shipping costs shall be deemed to have been incurred. The Seller is entitled to deduct these shipping costs from any refund amount and/or charge them again for a new delivery.
This does not apply to the costs of sending the goods to the Customer if the Customer effectively exercises their right of withdrawal.
5.3 If the Customer acts as an entrepreneur, the risk of accidental loss or deterioration of the goods shall pass to the Customer as soon as the Seller has delivered the goods to the carrier.
If the Customer acts as a consumer, the risk of accidental loss or deterioration of the goods shall generally pass only upon delivery of the goods to the Customer or an authorized person.
5.4 The Seller reserves the right to withdraw from the contract in the event of incorrect or improper self-supply.
5.5 Self-collection is not possible for logistical reasons.
5.6 Vouchers are provided to the Customer as follows:
- by e-mail
6) Retention of Title
If the Seller makes advance deliveries, ownership of the delivered goods remains with the Seller until the purchase price owed has been paid in full.
7) Liability for Defects (Warranty)
The statutory provisions on liability for defects shall apply unless otherwise stipulated below.
Special provisions apply for entrepreneurs regarding limitation periods and inspection obligations under §377 HGB.
8) Redemption of Promotional Vouchers
Promotional vouchers issued free of charge as part of promotional campaigns can only be redeemed in the Seller’s online shop and only within the specified validity period.
Only one promotional voucher can be redeemed per order.
Promotional vouchers cannot be paid out in cash or accrue interest.
9) Redemption of Gift Vouchers
Gift vouchers purchased via the Seller’s online shop can be redeemed in the online shop or at YuliSkin Kosmetik Studio unless otherwise stated.
Gift vouchers are valid until the end of the third year following the year of purchase.
10) Applicable Law
All legal relationships between the parties shall be governed by the law of the Federal Republic of Germany, excluding the laws governing the international sale of movable goods.
11) Code of Conduct
- The Seller has submitted to the participation conditions of the eCommerce initiative “Fairness im Handel”, which can be viewed at https://www.fairness-im-handel.de/teilnahmebedingungen/.
12) Alternative Dispute Resolution
12.1 The EU Commission provides a platform for online dispute resolution at the following link: https://ec.europa.eu/consumers/odr
This platform serves as a point of contact for out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.
12.2 The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
